Terms of Service

1. Service Provider

The YouMakeIt service (the “Service”) is provided by Stéphane TCHETANGNI, an individual, based in Cotonou, Benin (“we”, “our”). Contact: support@youmakeit.io

Payments are processed by Dodo Payments, acting as Merchant of Record. As such, Dodo Payments appears on your bank statement and handles billing and applicable taxes.

2. Purpose

YouMakeIt is an online platform for AI-powered voiceover generation and tools for content creators. The Service includes in particular: text-to-speech voice generation, voice cloning, audio and video transcription, YouTube channel exploration, and writing assistance tools.

These Terms govern access to and use of the Service. By creating an account or using the Service, you accept these terms without reservation.

3. User Account

• Creating an account requires a valid email address (or sign-in via a third-party provider such as Google).
• You are responsible for the confidentiality of your credentials and for any activity carried out from your account.
• You must have the legal capacity to enter into a contract. The Service is not intended for individuals under 16 years of age.
• Disposable email addresses may be refused.
• We may suspend or close an account in the event of a breach of these Terms.

4. Credits and Plans

• The Service operates on a credit system: 1 credit corresponds to 1 character generated or transcribed.
• Plans (Free, Starter, Advanced, Premium) determine the number of credits granted, the accessible features, and usage limits. Plan details are published on the site and may change.
• Credits granted under a subscription are added to your existing balance.
• Credits have no monetary value and are neither transferable nor exchangeable for money.
• Prices are listed in US dollars (USD) and are subject to change; any price change will be notified before it takes effect for existing subscriptions.

5. Subscriptions, Renewal and Cancellation

• Subscriptions are monthly and renew automatically at term, unless cancelled by you before the renewal date.
• You may cancel at any time; cancellation takes effect at the end of the current period. No prorated refund is issued for the period already begun, subject to the Refund Policy.
• In the event of a failed payment, access to paid features may be suspended.

6. Acceptable Use

You agree not to use the Service to:

• generate a voice imitating a real person without their explicit consent, or impersonate another person;
• produce content that is misleading, defamatory, hateful, violent, harassing, or that incites hatred or discrimination;
• produce sexually explicit content, or content involving minors in any way whatsoever;
• create disinformation, fraudulent content, or impersonate a brand or an institution;
• transcribe or process content you do not hold the rights to;
• infringe intellectual property rights, or any applicable law;
• attempt to circumvent the Service's technical limitations, quotas, or security; automate requests in an abusive manner.

Failure to comply with these rules may result in immediate account suspension, without refund.

7. Voice Cloning — Consent

Voice cloning is only permitted for your own voice, or for the voice of a person who has given their explicit written consent. You warrant that you hold the necessary rights to any audio sample uploaded. You are solely responsible for the use made of cloned voices.

8. Content Ownership

• Your content: you retain ownership of the text you submit and the audio files you generate. Subject to payment of amounts due and compliance with these Terms, you may use the generated voiceovers for commercial purposes.
• Your cloned voices belong to you and remain private. They are not shared with third parties or used to train models.
• Our property: the Service, its brand, interface, and software components remain our exclusive property (or that of our licensors).

You grant us a limited license, strictly necessary for the technical operation of the Service (processing, temporary storage, delivery of files).

9. Artificial Intelligence Features

The Service relies on artificial intelligence models. Generated results (voices, text, transcriptions) may contain inaccuracies or imperfections. You are responsible for verifying and for the use you make of generated content. The Service is provided without guarantee of outcome.

10. Availability and Evolution of the Service

We strive to ensure the Service's availability, without guaranteeing uninterrupted access. Maintenance operations, updates, or incidents may temporarily affect access. We may evolve, modify, or discontinue features.

11. Limitation of Liability

To the extent permitted by applicable law:

• The Service is provided “as is”, without warranty of fitness for a particular purpose.
• Our liability, on any basis whatsoever, is limited to the amount you have actually paid us over the past twelve (12) months.
• We shall not be liable for indirect damages (loss of revenue, loss of data, reputational harm).
• You are solely responsible for the content you generate and its distribution.

12. Indemnification

You agree to indemnify us against any third-party claim arising from a use of the Service in breach of these Terms, particularly with regard to copyright, image rights, or voice rights.

13. Termination

You may close your account at any time. We may suspend or terminate your access in the event of a serious breach of these Terms, in particular the acceptable use rules, without refund.

14. Changes to these Terms

We may modify these Terms. Material changes will be notified (by email or within the Service) before they take effect. Continued use of the Service constitutes acceptance.

15. Governing Law and Disputes

These Terms are governed by the laws of Benin. Any dispute concerning their interpretation or performance shall fall within the jurisdiction of the courts competent for digital affairs, subject to mandatory provisions protecting consumers.
